The United States Congress is the political institution that holds all legislative power in the United States of America. Its legislative power derives from the Constitutional Act of America, and as such it may not abuse the trust it has been vested with. According to the Constitution of the United States, the U.S. Congress" main responsibility is to balance the country"s budget and fiscal issues. Thus, Congress has the right to levy taxes, to borrow funds, to coin money, as well as issue patents and copyrights. Furthermore, Congress is responsible for regulating commercial enterprises and establishing trade relationships amongst states or with other nations. From an international point of view, it may also declare war, organize the U.S. military forces and federal courts. It may not, however, infringe onto the judicial chamber of the federal government by calling suspects in front of the court of law or passing a judicial sentence. Congress is only allowed to investigate the executive branch of power by delegating committees to supervise the activities of those who hold office. Finally, the U.S. Congress also has the power to break a deadlock during electoral colleges by appointing the President from among those candidates who had previously obtained the highest number of votes.
The United States Congress has a bicameral constitution. Its two main chambers are comprised of the House of Representatives and the Senate. Legislative power is distributed equally amongst the two houses even though each chamber controls different aspects of legislature. Thus, the House of Representatives is able to initiate impeachment procedures and issue bills for raising taxes and revenues. On the other hand, the Senate"s role is more advisory in nature as it gives its consent to presidential nominations and ratifies various treaties. Traditionally, both the House of Representatives and the Senate meet in the U.S. Capitol in Washington to hold Congress. Since the issues they are concerned with are different in nature, they meet in separate chambers to discuss and ratify bills. Nonetheless, it is not uncommon for both chambers to meet in joint sessions or pass joint resolutions, particularly around election time.
Elections are held in every even-numbered year, on the first Tuesday after the first Monday in November. This day is called "Election Day" in the United States, and all citizens are called upon to the polls to cast their vote for their Congressional representatives. As a rule, voters may choose to vote for such candidates as they have been put forth by their political parties during primary elections. Whereas the main political parties are comprised of the Republicans and the Democrats, ballots are not restricted to them alone. Independent and third party candidates also run for legislature, although their numbers and chances of success vary from state to state. Congressional members might be nominated for election by their respective parties, but their appointment is determined by a simple majority of votes. There is one notable exception to this procedure, however. In case a Senate position becomes vacant and special elections are called to fill the vacancy, the Governor of the Senate may temporarily appoint someone in that position.
Following general elections, the distribution of seats in Congress runs as follows. 435 seats are available for elected members from 50 U.S. states in the House of Representatives. Each state is apportioned a specific percentage of seats in the House of Representatives based on the size of the state and its population. Each of the states is guaranteed a seat in Congress and sends its representatives from its single-member constituencies known as congressional districts. Once in office, the House of Representatives elects its own Speaker from the head of the majority party to preside over proceedings. In contrast, the Senate is made up of 100 members, each two representing a different state regardless of size or number. As well, senators are not voted by districts but by states as a whole. They serve six-year terms rather than the traditional two occupied by their counterparts in the House of Representatives. A further notable difference between the two chambers is that the President of the Senate is not elected by his peers. The position is transferred automatically to the Vice-President of the United States, or in his absence to the most senior senator of the majority party.
