摘要 人工智能等技术的发展推动着算法逐渐超越了单纯的工具属性,成为了一种新的权力形态,并随着互联网平台的普及完成了向公共领域的权力扩散。算法权力的扩散使得各类平台承担起部分公共职能,推动着算法成为社会运行的重要规则,并在此基础上形成了一种以平台、数据和用户交互作为公共空间、公共资源和公共行为的新型权力运转模式。这种新的模式在促进社会进步的同时也不可避免地向社会引入了新的风险,具体表现为政策执行失真、权力结构失序、过程监管失灵以及主体行为失范四种形式。同时,由于算法应用所带来的问题与其产生的社会效益往往相伴而生,算法风险的治理会面临基础不牢、公私利益混淆、监管手段薄弱、价值导向偏离等多重困境,需要从制度构建、利益平衡、监管优化、人才培养等多方面进行探索。 With the development of artificial intelligence and other technologies,algorithms have gradually gone beyond mere tool attributes and become a new form of power.With the popularization of internet platforms,power has spread to the public domain.The diffusion of algorithm power makes all kinds of platforms assume part of the public functions,promoting algorithm to become an important rule of social operation,and on this basis,forming a new power operation mode with platform,data and user interaction as public space,public resources and public behavior.While this new model promotes social progress,it also inevitably introduces new risks to the society,which are embodied in four forms:policy implementation distortion,power structure disorder,process supervision failure,and subject behavior anomie.At the same time,as the problems brought about by the application of algorithm are often accompanied by its social benefits,the governance of algorithm risk will face multiple dilemmas such as weak foundation,confusion of public and private interests,weak supervision means and deviation of value orientation,which need to be explored from many aspects such as system construction,interest balance,supervision optimization and personnel training.
