摘要
如何筑牢法治“篱笆”,防止省级人大常委会越权的同时避免其失职,是当前中国法治领域亟待解决的重大现实问题。本文从省级人大与设区的市人大之间的权力关系着手探讨对法规的审查批准权,指出省级人大与设区的市人大之间存在复合型权力关系。本文认为,应善用两者之间的复合型权力关系,助力设区的市地方性法规的发展以及地方立法的质量提升。省级人大常委会应行使法定审批权对设区的市地方性法规进行法律监督,且审批权力边界仅限于合法性问题。同时,省级人大常委会有必要对设区的市地方性法规全过程依法开展业务指导和工作联系,以保障国家法律体系协调一致,提升设区的市地方立法质量。
In order to prevent the standing committee of provincial people's congress from overstepping its powers and avoiding its dereliction of duty,a“fence”of the rule of law should be built.This is a major practical problem that needs to be solved urgently in the field of the rule of law in China.This article starts from the power relationship between the provincial people's congress and the people's congress of a city divided into districts to discuss the power of review and approval of laws and regulations,finding out that the power relationship between the provincial people's congress and the people's congress of a city divided into districts is complex.The complex power relationship between the two should be used to facilitate the development of local regulation in cities divided into districts,while promoting the quality of their legislations.The statutory approval power to supervise the local regulations of cities divided into districts should be exercised,which is limited to the issue of legality.What's more,not only business coaching should be conducted,but working contacts should be made as well.These are of great importance to ensure the coordination of the national legal system and to improve the quality of the local regulations of cities divided into districts.
