摘要
附条件不起诉制度的设立,一方面契合修复性司法理念,体现刑罚个别化原则,另一方面也符合刑法谦抑性品格以及适应起诉便宜主义的要求。司法实践在认定涉罪未成年人“悔罪表现”时往往以犯罪行为发生后的表现来推定其主观认罪、悔罪的心理,存在一定的片面性,而且缺乏科学合理的监督考察体系。为充分发挥附条件不起诉的制度功能,对涉罪未成年人“悔罪表现”的认定应当采用全面、动态认定的路径,包括考量犯罪前、犯罪中、犯罪后以及监督考察期限内的具体表现;并辅之以建立科学合理监督考察体系,包括由司法行政机关牵头日常监督考察工作,优化监督考察期限的设置,实现帮教活动的规范化。
The conditional non-prosecution system established in the Criminal Procedure Law is not only corresponding to the reparative judicial philosophy and an embodiment of the principle of individualized penalty,but also in accord of the modesty principle of criminal law and the doctrine of prosecuting discretion.In the criminal justice,judicial officers usually identify the"repentance performance"of the juvenile criminal suspects on the basis of their performance after the occurrence of the criminal behavior,which is a partial analysis and lack of a scientific and reasonable system of supervision and inspection.In order to give full play to the function of the conditional non-prosecution system,this paper puts forward a comprehensive and dynamic method to identify the"repentance performance"of juvenile criminal suspects,including on the basis of the suspects′specific performance during the period of pre-crime,crime,post-crime,and supervision and inspection.In addition,a scientific and reasonable system of supervision and inspection should be established,including daily supervision and inspection work led by the judicial administrative organs,the optimization of the setting of supervision and inspection deadlines,and the standardization of assistance and educational activities.
