摘要
目前,我国房屋征收评估时点依法为征收决定的公告日,但该规定与现实存在矛盾,导致实践中迟延补偿大量存在,同案不同判、裁判理据缺失等问题显现。借鉴德国关于征地方面的立法及司法实践,在涉及房屋征收评估时点争议的案件时,应正确理解法律的内在精神,坚持评估时点非固化,确认征收补偿是否在合理期限内完成,着重考量过错原则,综合衡量评估点的重新选取。
At present,the evaluation time of housing expropriation is the announcement date of expropriation decision according to law,but there are contradictions between the regulation and the reality,resulting in a large number of delay compensation in practice,different judgments in the same case,lack of judicial basis and other problems.Referring to the legislation and judicial practice of land acquisition in Germany,we should correctly understand the inherent spirit of the law,adhere to the non fixed evaluation time point,confirm whether the collection compensation is completed within a reasonable period,focus on the principle of fault,and comprehensively measure the re selection of the evaluation point.
