摘要
逻辑正义属法律范畴,具有专业性和技术性,是基本正义;直觉正义属社会范畴,与传统道德规范相关,是更高层次正义。在热点刑事案件中,逻辑正义与直觉正义呈现冲突对立样态,给刑事司法活动带来诸多不利影响。这种现象的出现除了逻辑正义自身的局限性以外,还可归咎于公众法律意识的欠缺,此外网络媒体失范也扩大了两者之间的鸿沟。寻求逻辑正义与直觉正义的契合,包括司法机关重审直觉正义的价值、将正确的正义直觉纳入法官办案过程中;加强法治宣传教育、提高社会公众对逻辑正义的接受度;规范网络媒体的行为、加强媒体自律等。
Logical justice belongs to the category of law,which is professional and technical,and is the basic justice;intuitive justice belongs to the category of society,which is related to traditional moral norms and is a higherlevel justice.In hot criminal cases,logical justice and intuitive justice are in conflict with each other,which brings adverse effects to criminal judicial activities.In addition to the limitations of logical justice itself,this phenomenon can also be attributed to the lack of public legal awareness.In addition,the anomia of network media also widens the gap between the two.To seek the combination of logical justice and intuitive justice,the judicial organs should review the value of intuitive justice,bring the correct justice intuition into the process of judges’handling cases.Secondly,we also should strengthen the publicity and education of the rule of law and improve the public’s acceptance of logical justice.Finally,it is necessary to standardize the behavior of network media and strengthen media selfdiscipline.
