摘要
平台经济时代下,利用大数据和算法已经成为平台进行商业竞争的主要手段。平台利用其显著的信息、资源优势进行平台垄断,影响市场秩序,侵害消费者权利。平台算法价格歧视围绕用户、数据和资金展开,以关联性歧视和导向性歧视为主要表现形式,呈现出歧视行为实施的隐蔽性、消费者权益的剥削性以及市场竞争的排除性等特征。目前,我国对平台算法价格歧视的反垄断法律规制仍存在主体条件确定困难、事实要素认定困难、消费者举证难度大等现实困境。因此,应立足权利规则,从扩张主体界定范围、明确事实构成要素、完善权利救济制度等路径进行优化,积极推进平台算法歧视的反垄断规制,保障平台经济有序、健康、稳定发展。
In the era of the platform economy,big data and algorithms have become the main means of business competition.The platform uses its significant information,and resource advantages to carry out platform monopoly,affect the market order,and infringe on consumer rights.The platform algorithm price discrimination revolves around users,data,and funds,with relevance discrimination and orientation discrimination as the main manifestations,it is characterized by the concealment of discrimination,exploitation of consumer rights,and the exclusion of market competition.At present,the anti-monopoly legal regulation of platform algorithm price discrimination in our country still has some difficulties,such as the determination of subject condition,the lack of fact elements,and the difficulty for consumers to prove their case.Therefore,based on the right rules,it is necessary to optimize the anti-monopoly regulation of platform algorithm discrimination by expanding the scope of the subject,defining the elements of the facts,and perfecting the right relief system.The orderly,normal,and stable development of the platform economy will be ensured.
