摘要
最高人民法院相关指导性案例确认了公立高校的行政诉讼主体资格及拒绝授予学位行为的可诉性、法院对高校校规的司法审查权限、不同类型学位纠纷的不同审查限度,以及正当法律程序原则的强制适用。高校自主设定论文指标作为博士学位授予资格要件具备正当性,是学术自治原则在高等学校办学过程中的具体体现。高校二级学院运行机制的核心在于加强对学术权的保障。高校二级学院设定严于校规的学术标准,符合教育政策理念与教育科学规律,且合乎法理及司法实践。经高校授权、批准的二级学院"学院规则"与"校规"具有同等效力,二者是"特别法"与"一般法"的关系。司法机关在对"学院规则"进行审查时,须秉持谦抑性,一方面开展有限的合法性审查,另一方面重点审查其程序面向。
The relevant guiding cases of the Supreme People’s Court have confirmed the subject qualifications of administrative litigation in public universities and the actionability of universities’refusing to grant academic degree,the court’s judicial review authority over university regulations,different limitations in reviewing different types of disputes in degree granting,and the compulsory application of the principle of due process of law.It is legitimate for colleges and universities to independently set the thesis standards as the qualification of doctoral degree awarding,which is the embodiment of the principle of academic autonomy.The core of the operation mechanism of the secondary college lies in strengthening the guarantee of the academic right.The second level colleges setting academic standards that are stricter than the school rules are in line with the concept of educational policy and the laws of educational science,and in line with legal principles and judicial practice.There is equality between"college rules"and"school rules"of secondary colleges authorized by universities.Their relationship is the same as that between"special law"and"general law".When reviewing the"college rules",the judicial organ should be modest.On the one hand,it should carry out limited legitimacy review,on the other hand,it should focus on reviewing its procedural orientation.
