住宅项目专项借款政策实施过程中的抵押问题研究

摘要 在专项借款政策实施过程中,对于已经预售的住宅商品房项目的续建部分,只办理了商品房预售备案登记,未办理预告登记的,在商品房竣工验收合格后、购房人办理产权证前,开发商有权将购房人签订的商品房预售合同项下的商品房抵押给出借专项借款的银行。对于未预售的住宅商品房项目的复工续建部分,如果出借专项借款的银行要求就续建部分设立抵押,宜把续建部分拆分成独立的商品房单元,就每个独立的商品房单元分别设立抵押权。 In the implementation process of the special item loan policy,for the continuation of residential commercial housing projects that have already been pre-sale,only the pre-sale registration of commercial housing has been processed.If the pre-sale registration has not been processed,the developer has the right to mortgage the commercial housing under the pre-sale contract signed by the buyer to the bank lending the special item loan after the completion and acceptance of the commercial housing and before the buyer applies for the property certificate.For the resumption of residential commercial housing projects that have not been sold in advance,if the bank lending the special item loan requires the continuation part to be mortgaged,it is advisable to split the continuation part into independent commercial housing units and establish mortgage rights for each independent commercial housing unit.
