摘要
案件裁判是裁判者是运用证据碎片还原案件事实的过程。从证据材料到裁判事实,案件真相从来不是不证自明的,这一过程离不开法官心证。但是,法官心证不仅隐性扩大了其自由裁量权,增加权力滥用的风险,而且使得裁判结果无从检验。因此,心证透明化是法庭事实认知亟待解决的问题。作为集逻辑推理、论辩商谈、语用修辞传统三大论证方法于一体的事实建构模式,叙事既是裁判过程本质的外化表现,又是一种符合本土实际的整体主义的证明进路。当前,明确将叙事作为事实认知的逻辑架构,有助于适度厘清和消解我国存在的事实认知方法缺乏、认知规则混乱、认知能力有限等多重困境,增强裁判的说服力,达到服判息诉的目的。未来,在承认叙事正向功用的基础上,还应重构裁判叙事的作用机制,保证叙事在兼顾情、理、法的轨道上规范运行。
From evidentiary materials to adjudication facts,it is never self-evident.The adjudication process is the process of using evidence fragments to restore the facts of the case,which is inseparable from the judge's heart testimony.At present,judges'heart testimony not only implicitly expands their discretion,increases the risk of abuse of power,but also makes the adjudication results impossible to test.It can be seen that the transparency of heart testimony is an urgent problem to be solved in court's perception of facts.As a factual construction model that integrates the three traditional argumentation methods of logical reasoning,argumentation and negotiation,and pragmatic rhetoric,narrative is not only an externalized expression of the essence of the adjudication process,but also a proof approach of holism that conforms to local reality.The logical structure of clearly using narrative as factual cognition helps to appropriately clarify and resolve the multiple dilemmas that currently exist in our country,such as the lack of factual cognition methods,chaotic cognitive rules,and limited cognitive ability,enhance the adjudication's persuasive power,and achieve the purpose of persuading the judgment.On the basis of acknowledging the positive function of the narrative,the mechanism of the referee's narrative should be reconstructed in the future,so as to maintain the standardized operation of the narrativeon the track of taking into account emotion,reason and law.
