摘要
当前《著作权法》关于合理使用的有关规定难以完全适应公共图书馆数字化建设的发展,公共图书馆的数字化复制行为有关的合理使用制度需加以完善。可通过借鉴版权法体系的相关制度设计,进一步扩张合理使用的适用情形,并对三步检验法的具体适用提供具体化路径,以完善合理使用制度,平衡相关主体的利益。
The current"Copyright Law"on fair use is difficult to fully adapt to the development of digital construction of public libraries.The digital copying behavior of public libraries is also very easy to cause copyright conflicts.the relevant fair use system needs to be improved.We can further expand the application of reasonable use by drawing on the relevant system design of the copyright law system,and provide a concrete path for the specific application of the three-step test method to improve the reasonable use system and balance the interests of relevant subjects.
