摘要
景区迁坟有利于景区的高质量发展和景区所在地经济的发展,但景区迁坟存在侵犯死者近亲属孝思忆念权、风水权等弊端。从公私益价值衡量,景区迁坟个人私益须对公共利益作出适当让步。然而,由于景区迁坟私权保护规范阙如,致使景区迁坟由政府强势推动,公权力缺乏制约,私权益缺乏保护,景区迁坟运行不畅。这客观上要求地方立法在尊重民间丧葬规范的基础上,建构包含权利、义务、责任、程序与救济等具体内容的规则,实现对景区迁坟的有效规制。
Moving graves in scenic spots is conducive to the high-quality development of scenic spots and the economic development of the scenic spots,but there are some drawbacks such as infringing on the right of filial piety,remembrance and geomancy of the close relatives of the deceased.From the value of public and private interests,the private interests of moving graves in scenic spots must make appropriate concessions to the public interests.However,due to the lack of protection norms for private rights in scenic spots,the relocation of scenic spots is strongly promoted by the government,with the lack of restriction of public power and protection of private rights and interests.This objectively requires local legislation to construct rules including rights,obligations,responsibilities,procedures and relief on the basis of respecting folk funeral norms,so as to effectively regulate the relocation of graves in scenic spots.
