摘要
随着《民法典》《民间借贷规定(2020修正)》及《关于办理非法放贷刑事案件若干问题的意见》的陆续颁布,我国逐渐形成了从民法到刑法、从法规到法律的民间借贷法律规范体系。采用刑法规制经营性高利贷行为是因其具有足够的社会危害性与刑事可罚性。高利贷不仅不是借贷人的真实意思表示,而且严重影响金融安全,破坏传统信用体系。同时刑法也是民间借贷法律规范体系中的重要强制力保障,其意图在于压缩非法借贷行为的空间,试图降低实体经济融资成本,服务实体经济发展。应当从法体系的角度来考虑借贷利率空白地带的定性问题,视其为违法但不犯罪的空白地带。
With the promulgation of“Opinions on Illegal Lending”,“Civil Code”and“Provisions on Folk Lending(2020 Amendment)”,China has gradually formed a legal standard system of folk lending from civil law to criminal law,and from regulations to laws.Criminal law is adopted to regulate commercial usury behavior because it has enough social harm and criminal punishment which is not only not the real intention of the borrower,but also seriously affects financial security and destroys the traditional credit system.At the same time,criminal law is also an important coercive force guarantee in the legal standard system of folk lending.Its intention is to reduce the space of illegal lending behaviors,try to reduce the financing cost of the real economy,and serve the development of the real economy.We should consider the qualitative problem of interest rate blank zone from the angle of law system and regard it as a blank zone which is illegal but not criminal.
