摘要
教育法治建设既是综合运用法治思维和法治方式解决教育问题的手段,也是教育领域实现良法善治的目标。教育法治建设作为破解我国教育发展时代难题的重要进路,是实现全面依法治国的必要构成版块,还能够有效规制教育领域的非理性行为。新中国成立以来我国教育法治建设经历了迷失、勃兴、发展、完备的实践历程,尤其是在党的十八大之后,取得了卓越的成就,但也面临着一系列的现实困境。新时代我国教育法治建设应当加强完善立法、行政、司法等环节,重视教育发展的平衡性和充分性,保障教育参与主体的基本权利,注重对民办教育的合理规制。
The legal construction of education is not only a means of solving educational problems through the comprehensive application of legal thinking and legal methods,but also the goal of achieving good law and good governance in the field of education.The legal construction of education,as an important step forward solving the difficulties of China’s educational development,is a necessary component of realizing a state governed by the rule of law in an all-round manner,and can effectively curb irrational behaviour in the field of education.Since the founding of New China,the legal construction of education in China has undergone a practical journey of disorientation,prosperity,development and completion,especially after the 18 th National Congress of the Communist Party of China(CPC),and has made outstanding achievements,but it also faces a series of practical difficulties.Hence,in the new era,the legal construction of China’s education should strengthen and improve the legislative,administrative and judicial aspects,pay attention to the balance and adequacy of education development,protect the basic rights of education participants,and focus on reasonable regulation of private education.
