摘要
学校的人才培养和社会的需求之间的矛盾,是一个永恒的问题,也是当前教学改革过程中所要关注的问题。在当前法学教育中,从学生的个性发展出发以及社会的需求出发,为法律行业提供高质量的人才,是法学教育的重点内容。在法学教学中,我们需要培养出什么样的人才,这便决定了法律专业当前的课程是设置以及今后学生的提升方向,当学生进入社会中利用什么形式的法律来维护社会中的公平正义等等,维系一个什么样的社会。其实,法学归根结底是为了社会而服务,不是冷冰冰的法律条文,而是这些法律条文背后的价值观念的维护,是社会秩序的构建。因此,在法学教学中,所开展的是学生综合素养的提升,从学生的法学基本素养出发,为学生开展良好的职业教育,为落实"依法治国"奠定基础。本文主要从法学教育的基础矛盾、法学教育的根本性缺陷以及法学教育的改革方向,这三方面进行了详细的阐述。
The contradiction between the school’s personnel training and the needs of the society is an eternal problem,and it is also a problem to be concerned in the process of the current teaching reform.In the current legal education,it is the key content of legal education to provide high-quality talents for the legal industry from the perspective of students’personality development and social needs.In the teaching of law,we need to cultivate what kind of talents,which determines the current curriculum of law major and the promotion direction of students in the future.When students enter the society,what kind of law is used to maintain the fairness and justice of the society,and what kind of society to maintain.In fact,in the final analysis,law is to serve the society,not the cold legal provisions,but the maintenance of the values behind these legal provisions,and the construction of social order.Therefore,in the teaching of law,what we are doing is to improve the comprehensive quality of students.Starting from the basic quality of students’law,we should carry out good vocational education for students and lay the foundation for the implementation of"rule of law".This paper mainly expounds the basic contradictions,the fundamental defects and the reform direction of law education.
