摘要
以“AI换脸”为代表的“深度伪造型”新型犯罪具有极易发生电信诈骗、滋生网络谣言、证据不易保存等特点,冲击人伦道德、冲破法律底线、干扰正常监管,社会危害严重,法益侵害极大,给案件侦破带来诸多困扰。公安机关需结合个案特点,提高侦查工作的技术应用,加大打击力度,强化法律规制,完善对平台运营商的管理,实现对“深度伪造型”新型犯罪的综合治理。
The new type of deepfake crime represented by"face changing with artificial intelligence"easily leads to telecommunications fraud,breeding network rumors,and the evidence which is not easy to be preserved.It impacts human relations and morality,breaks through bottom line in law,interferes with normal supervision,causes serious harm in society,greatly infringes legal interests,and brings many troubles to the detection of cases.Combining with the characteristics of individual cases,public security organs need to enhance the technical application in investigation,intensify crackdown,strengthen legal regulation,improve the management of platform operators,and realize the comprehensive governance on deepfake crimes.
