义务教育均衡发展法治化:成就、问题与展望

Legalization of Balanced Development of Compulsory Education:Achievements,Problems and Prospects

摘要 20世纪90年代末以来,我国义务教育均衡发展法治化取得了一系列成就。义务教育均衡发展治理理念从管理本位转向权利本位,治理手段从政策之治转向法治,治理内容从碎片治理走向整体性治理。但是,义务教育均衡发展法治化离全面依法治国和依法治教的基本要求还有一定的差距。教育治理法治化要求我们以法治思维和法治方式推进义务教育均衡发展。首先,要坚持义务教育均衡发展立法先行。其次,要做到依法行政,明确政府及相关主管部门的权力边界和责任范围。再次,必须加强义务教育法律的可诉性,为公民平等受教育权的实现提供可靠的法律保障。 Since the end of 1990s,China has made a series of achievements in legalization of balanced development of compulsory education.The govermance concept of balanced development of compulsory education has changed from management-based to right-based,the governance means has changed from policy governance to rule of law,and the governance content has changed from fragmented governance to holistic governance.However,there is still a certain gap between the balanced development of compulsory education and the basic requirements of comprehensively governing the country according to law and administering education according to law.The legalization of educational governance requires us to promote the balanced development of compulsory education with the rule of law.First of all,we should insist on legislation and formulate a perfect legal system for the balanced development of compulsory education.Secondly,it is necessary to administer according to law and clarify the power boundary and responsibility scope of the government and its relevant competent departments.Thirdly,we must strengthen the litigious nature of compulsory education law to provide reliable legal guarantee for the realization of citizens'equal right to education.
