摘要
教育性是教育内涵的核心表达,也是教育惩戒的价值遵循。“教育惩戒”强调教育性价值,遵循教育性原则,重视教育性手段,因此排除了体罚、变相体罚等明显具有反教育性的惩戒措施。应该将维护和引导教育性作为教育惩戒立法的目标价值,并促进“惩戒事实”与“教育规范”的辩证统一。
Instructiveness is the core expression of educational connotation,and also the value of educational discipline.Educational discipline emphasizes educational values,follows educational principles,and values educational methods.Therefore,it excludes corporal punishment and disguised corporal punishment,which are clearly anti-educational disciplinary measure.We should regard maintaining and guiding instructiveness as the target value of educational discipline legislation,and promote the dialectical umification of“discipinal facts”and“educational norms”.
