地方教育督导立法:问题与改进——基于37部地方立法文本的考察

摘要 自《教育督导条例》颁布以来,各地陆续制定或者修订地方性法规予以落实。通过对37部地方立法文本的分析,可发现地方教育督导立法呈现出立法主体多层级、立法时间跨度大、立法文本规范多样化等特征。审视地方教育督导立法的时效与内容,主要存在要害问题虚化、操作性欠缺,地域特色不明显、针对性不强,部分条款滞后、难以满足时代发展要求,法律规范软化、强制性不足等问题。未来我国地方教育督导立法应在以下方面进一步改进:充实立法内容、增强操作性,凸显地方特色、增强针对性,顺应时代发展、明确立法导向,加强“硬法”规制、提高立法效能。 Since the promulgation of the Regulations on Education Supervision,local regulations have been formulated or revised to implement it.Through the analysis on 37 local legislative texts,this paper finds that local education supervision legislation shows the characteristics of multiple levels of formulation subjects,a large time span of formulation,and diverse regulations of legislative texts.Examining the timeliness and content of local education supervision legislation,the main problems are as follows:key issues are blurred,lack of operability,unobvious regional characteristics,not strong pertinence,some provisions are lagging behind and can not meet the development requirements of the times,softening legal norms are not mandatory.In the future,China’s local education supervision legislation should be further improved in the following aspects:enriching the legislative content,enhancing operability,highlighting local characteristics,enhancing pertinence,conforming to the development of the times,clarifying the legislative orientation,strengthening the system of hard laws and regulations,and improving the effectiveness of legislation.
