摘要
家庭教育缺失带来的社会问题要求国家尽快出台并完善家庭教育法律。在《中华人民共和国家庭教育促进法》颁布之前,家庭教育法律责任散见于《中华人民共和国义务教育法》《中华人民共和国未成年人保护法》《中华人民共和国预防未成年人犯罪法》等法律中,少数地方家庭教育法规中也有法律责任专章内容,但是家庭教育法律责任仍然存在责任主体不统一、责任内容阐释模糊、责任惩处力度不强等问题。家庭教育法律责任的设置应当从减少责任虚置、健全制度体系、加强法律监督等方面着手改善。
The social problems caused by the lack of family education urge the country to introduce and improve the family education legal system as soon as possible.Before the promulgation of Family Education Promotion Law of the People’s Republic of China,the legal responsibility of family education is scattered in the Compulsory Education Law of the People’s Republic of China,The Law of the People’s Republic of China on the Protection of Juveniles.The Law of the People’s Republic of China on the Prevention of Juvenile Crimes and other laws.Some provincial regulations also have the content of responsibility,but the legal responsibility of family education still has problems such as the inconsistent subject of responsibility,the vague interpretation of the content of legal responsibility,and the weak punishment of legal responsibility.The establishment of legal responsibility of family education should be improved from the aspects of reducing false responsibilities,improving the system,and strengthening legal supervision.
