摘要
国家教育考试法治化的推进对高考加分政策的规范性及公平性提出了更高要求。以H省现有少数民族考生高考加分政策及2019年相关数据为基础,可以看到H省现行政策执行过程整体规范严格,有效实现了预期效果,但也存在政策解读不够准确、权力行使有欠妥当、与上位法不尽相符的问题,需要在法治基础上优化政策解读过程、依法行使行政权力、制定专项法律法规,以依法治考推动教育公平的实现。
Since the advancement of legalization of national education examination puts forward higher requirements for the standardization and fairness ofit,the present article intends to conduct a legal analysis of the preferential policy that awards bonus points in the national college entrance exams,or gaokao.Based onthe bonus-point system in gaokao and the data of 2019 in H province,the present article finds that the current policies in H Province are well implemented and have achieved expected results.However,there are also problems such as inaccurate policy interpretation,improper exercise of power,and inconsistent compliance with superior laws,which need to be resolved by means of optimization of the policy interpretation process,the law-based exercise of administrative powers,and the formulation of special laws and regulations.Only in this way,can the legalization of education fairness be promoted.
