摘要
从立法能力入手,逐渐剥离出立法行为能力,该理论的确立具有适当的政策理论支撑、合理的法理基础和必要的实践需求。立法行为能力是立法主体通过自身的立法行为,把宪法和法律规定的立法职权具体化为法律法规的能力,涵括政策把握能力、立法项目选择能力、立法项目调研能力、法律草案起草能力、与多元主体沟通能力和法律法规的解释能力等。对立法行为能力产生影响的因素既有立法理念、知识、技术、经验等内部因素;又有立法体制、立法环境等外部因素。立法质量是评判立法行为能力的外在标准。地方立法主体立法行为能力的提升,有赖于从立法主体的建设与法律、财物保障、社会氛围培育内外两个方面改进和完善。
Starting from the legislative capacity,it gradually separates the legislative behavior capacity.The establishment of this theory has the support of appropriate policy theory,reasonable legal basis and necessary practical needs.Legislative beharioral capacity refers to the ability of legislative subjects to translate the legislative authority stipulated by the Constitution and laws into laws and regulations through their own legislative behavior,including the ability to grasp policies,the ability to select legislative items,the ability to investigate legislative items,the ability to draft laws,the ability to communicate with multiple subjects and the ability to interpret laws and regulations.There are not only internal factors such as legislative idea,knowledge,technology and experience,but also external factors such as legislative system and legislative environment.The quality of legislation is the external standard to judge the legislation behavioral capacity.The promotion of legislative beharioral capacity of local legislative subject depends on the improvement and perfection of the construction of legislative subject and the law,the guarantee of property and material and the cultivation of the social atmosphere.
