摘要
《海牙信托公约》中的信托定义只是明示信托定义;但它在范围上只能够涵盖合同信托和遗嘱信托,而并不能够涵盖宣言信托。此项信托定义的最为显著的标新立异在于以入门功能为其功能;这致使它成为一项对信托关系具有认识论价值的信托定义。有外国学者着眼于记载此项信托定义的公约第2条第1款中的解释空间,认为该公约确认信托财产所有权在信托存续期间由委托人享有;此款能够为这一看法提供支持。有外国学者认为此项信托定义在涵义上能够覆盖代理、委任和寄存;尽管有关的反驳意见有相当说服力,但这一看法却能够与有关国家和地区的信托法理论中的所谓信托即代理说和所谓信托即寄存说相协调。在内容上具有显著恰当性和其入门功能具有显著可操作性为此项信托定义的显著优点,这致使它已经对一些国家和地区的关于信托定义的立法和理论研究产生了影响。
The trust definition in the Hague Trust Convention is only express trust definition;but the scope of the trust definition can only contain contract trust and testament trust, can not contain declaration trust. The having the gateway function is the most prominent new meaning of trust definition;this makes the trust definition a trust definition for trust relationship having epistemology value. A foreign scholar thinks the convention affirming trust property ownership enjoying by settlor during trust existence with a view to the interpretation space within about recording the trust definition’ the first paragraph of Article 2 of the convention;the paragraph can provide support for the view. A foreign scholar thinks the meaning of the trust definition can covers agency, mandate and bailment;though relative contradiction opinion haves considerable persuasion, but the opinion can coordinate with the doctrine that trust is agency and the doctrine that trust is bailment within relative countries and areas’ trust law theory. The prominent merit of the trust definition is the content having prominent appropriateness and the gateway function having prominent operability;this haves brings the trust definition having an effect for some countries and areas ’ the legislation and theory study of trust definition.
