摘要
学者将开发商控制之下的物业公司对自主开发的小区进行管理的现象称之为物业管理当中的"父子兵"体制,这些公司普遍面临物业矛盾频发与持续亏损的困境。造成这一现象的主要原因是"父子兵"体制下物业公司的经营行为往往围绕开发商的需求以违背市场规律的方式开展,这一做法不仅导致物业管理难以形成良性循环的常态运行机制,而且从整体上影响了物业服务行业的质价相符原则,挤压了一般物业公司的生存空间。这提示我们仅依靠市场主体的力量难以达成小区的有效治理,亟须从法律制度上予以回应,破除开发商对于物业管理的垄断。
Some researchers regard it as a fuzi bing(literally father/son soldiers)system of property management when the property is managed by a company which is under the control of the developer of the property.Property management companies of this type generally face the dilemma of having frequent conflicts with the property owners and suffer continuous losses.The main cause for this phenomenon is that the activities of the property management company under the fuzi bing system often revolve around the needs of the developers in a manner that violates the market principle.This practice not only makes it difficult for property management to form a normal and effective operating mechanism,but as a whole has affected the principle requiring the correspondence between price and quality followed by the property service industry and suppressed the living space of the property companies independent of the property developers.This reminds us that it is difficult to achieve effective governance of the community only by relying on the force of market players,which means that it is urgent to break the developer’s monopoly on property management with corresponding legal response.
