摘要
多部党内法规共同构造的责任制度是中国共产党党内法规制度的重要组成部分,内容主要包括责任原则、主体责任、领导责任、对党员干部的纪律处分等。党内法规构造的责任可能与政务处分、刑事责任竞合,但因为责任后果可彼此相容,故可同时适用。党内法规责任的从轻、减轻、免除、从重或加重,必须严格遵守相关规定。中国共产党党内法规设定的责任制度,是全球各主要政党中责任制度最为全面、最为严厉的制度,具有鲜明的中国特色和系统化、规范化、专业化特征;是一个由轻到重的梯级责任体系,且高度注重对违法违纪行为的预防,以及与法律责任的有机衔接。党内法规责任在制度设定中对法律责任制度和理念予以借鉴,同时也有很大的创新,如创立了主体责任、管理责任、终身追责制度,建立了党内监督执纪机构等。
As an important branch of CPC regulations,liability system constructed by several party regulations covers principles of liability,subject responsibilities,leadership responsibilities as while as disciplinary sanction on party members and cadres.Concurrence between liabilities constructed by party regulations and administrative disciplines,criminal liabilities can be solved by simultaneous application for their consequences compatible with each other.Liabilities of party regulations can be lighter,mitigated,exempted,heavier or aggravated only strictly according to relevant regulations.Being systematic,normative,specialized and with Chinese characteristics,the liability system of CPC is the most comprehensive and the most severe among main parties all over the world.The liability system presents as a steps from light to heavy and focuses on preventing offense,connecting with legal liability.Liability of party regulations has not only taking a page from legal liability system in designation,but also innovating on subject responsibility,management responsibility,lifelong accountability and inner-party discipline enforcement organization,etc.
