摘要
随着经济立法的发展,经济法新型责任形态不断涌现,对其可以从“形式-状态”两个维度展开研讨:一方面,从责任形式维度,应分析经济法新型责任形式的类型、立法体现及相关影响因素,揭示其对既有责任形式的拓展;另一方面,从责任状态维度,应当对上述责任形式的生成、分布、适用和演变等存续状态进行挖掘,以揭示其背后的责任原理和责任机制,并促进经济法责任制度的结构和功能的完善。责任形式及其存续状态,体现了特定的法律价值和法治理念,其蕴含的经济法治逻辑会直接影响经济法规范结构和经济法秩序的形成。把握经济法治逻辑,既有助于理解经济法责任与其他部门法责任的差异性和互补性,推进整体法治体系的完善,也有助于整合经济法的规范论与价值论、运行论的研究,推动经济法责任理论乃至整体法律责任理论的深化。
With the development of economic legislation,new liability form and state of economic law emerge continuously,which can be studied from two dimensions of form and state.On the one hand,from the perspective of liability form,the types,legislative embodiment and relevant influencing factors of the new liability form of economic law shall be analyzed to reveal its expansion of the existing liability form.On the other hand,from the perspective of liability state,we should explore the series of existence states of the generation,distribution,application and evolution of the above liability forms so as to reveal the underlying liability principles and liability mechanism and to promote the perfection of the structure and function of the liability system of economic law.The above forms of liability and its states of existence embody the specific legal value and idea of rule of law,and the logic of rule by economy law contained in it will directly affect the formation of normative structure and order of economic law.Grasping the logic of rule by economy law is helpful to understand the difference and complementarity between the liability of economic law and the liability of other departments,and to perfect the whole legal system,and to integrate the theory of norms,value and operation of economic law,and to deepen the theory of liability of economic law and the whole legal liability.
