摘要
按小时费率计收仲裁员报酬是国际商事仲裁的常见做法,但由于我国仲裁行业存在特殊情况,仅有少数仲裁机构的仲裁规则允许仲裁员按小时计费。为探究该收费制度在我国推广的可行性,本文将梳理域内外学者研究成果,对按小时费率计收仲裁员报酬制度的优缺点与监督机制进行总结。通过对现有研究成果未解决的问题进行总结与反思,本文认为,在我国实施按小时费率计收仲裁员报酬利大于弊,且时机已经成熟,目前主要的任务是在机构仲裁中建立仲裁机构与法院依顺序参与的监督机制,并在将来可能实行的临时仲裁中建立法院主导的监督机制,让按小时费率计收仲裁员报酬制度顺利落地实施。
Arbitrators being paid at hourly rates is a common practice in international commercial arbitration.However,only a few arbitration institutions in China have issued rules allowing arbitrators to be paid on an hourly basis due to the specific circumstance in Chinese arbitration.In order to explore the feasibility of popularizing hourly rate system in China,this article reviews the existing researches of scholars worldwide and summarizes the advantages,disadvantages and the possible monitoring mechanisms of the hourly rate system for arbitrator’s remuneration.This article concludes that the advantages of implementing an hourly rate for arbitrator’s remuneration has outweighed the disadvantages and that it is now the propriate time for the system to be implemented in China.The main task at this stage is to establish a monitoring mechanism involving both arbitration institution and judicial court by stages for institutionalized arbitration,and a monitoring system lead by judicial court for ad hoc arbitration to assure a smooth implementation.
