摘要
本综述通过对2021年收录于主要中文数据库、国家图书馆以及纸质期刊中的商事仲裁中文类研究文献的检索与整理,以期较客观地展示2021年商事仲裁中文类研究文献的主要内容与基本特征。2021年商事仲裁中文类研究文献在数量上较2020年度有所减少,来源于法学类核心期刊的文献占比亦随之下降,但著作类文献数量增幅显著,源于仲裁专业期刊的论文类文献占比亦较上一年有所增加,且所涉研究对象在仲裁法修订背景下更趋集中,聚焦于国际投资仲裁、多元化争议解决机制等时下现实问题。其中国际投资仲裁问题研究最为瞩目。同时,言之无物的文献明显减少,真知灼见的研究成果则彰彰在目,为我国仲裁立法完善和制度创新提供了强有力的理论支撑。
This review aims to objectively index and cover the main content and basic characteristics of Chinese research on commercial arbitration in 2021,by searching and collating literature and books recorded in major Chinese databases,the National Library and paper journals.The number of Chinese research documents on commercial arbitration and the percentage of literature both show a decrease compared to the previous year.In contrast,the number of monographs has increased significantly,and the proportion of papers from professional arbitration journals is also on the rise from the previous year.In terms of the object of these studies,it demonstrates a greater tendency to concentrate toward international investment arbitration,diversified dispute resolution mechanism that appeared in practice,among which the study of international investment arbitration remains the most prominent.Meanwhile,studies that cover empty verbiage dramatically decreased,whereas insightful research findings were emerging,providing a strong theoretical support for China’s arbitral legislation and institutional innovation.
