摘要
在后冷战国际格局演变过程中,中国与其他新兴国家的群体性崛起成为引人注目的重大事件。新兴国家在推动国际法发展变化过程中发挥了突出作用,至少表现在阻止国际和平与安全领域国际法的异变及促进国际司法公平多元发展等方面,而新兴国家群体性崛起推动国际法发展变化的过程明显呈现出渐进而不是突变的特点。群体性崛起的新兴国家能否主导21世纪整个上半叶国际法的走向,关键就在于新兴国家是否能够为国际社会提供足够多的安全、经济发展、人权保护、国际规则等公共物品,为国际秩序的重构做出实质的积极贡献。
It is noted that the rise of China together with a group of other emerging States is undoubtedly a major event in the evolution of the post-Cold War international regime.The rise of emerging States has had profound impact on the development of international law,featuring in restraining alienation of international law in the field of international peace and security,and enhancing justice and diversity in the international judicial system.It is noteworthy that the change of international law promoted by the rise of emerging States has shown a path of evolution instead of revolution.Whether the rise of emerging States can dominate the path of international law development in the first half of 21century will largely lies in the capacity of these States to provide the international community with adequate public goods for security,economic development,human right protection as well as new international norms,and their substantive contribution to the re-construction of the world order.
