摘要
法律适用沟通交流是法官确保法律适用统一的重要机制。司法改革后,尤其是内部机构改革背景下,法律适用沟通交流机制发生重大转变。在法律适用过程中,法官并非自动地导出判决结果,其法律适用的过程受交流体制、认知水平、社会伦理、社会政治等复杂因素的影响。当前法院改判发回案件的法律适用沟通交流模式存在诸多问题,严重影响了法律适用沟通交流的统一。法院应抓住司法改革契机,借助当前智慧法院建设,参照知识交流,积极构建法律知识与思维的共享网络交流平台,以建立有效的法律适用沟通交流机制。
The communication and exchange about the application of law is an important mechanism for judges to ensure the uniform application of law.After the judicial reform,especially in the context of the reform on internal organizations,the communication&exchange mechanism for the application of law is undergoing major changes.In the process of law application,affected by the communication system,cognitive level,social ethics,social politics and other complex factors,a judge is unable to automatically get the judgment result.For many cases whose original sentences are changed by the courts,there exist problems in the communication mode for the application of law,and thus having seriously affected the uniform application of law.The court should seize the opportunity of judicial reform,take advantage of the current smart court construction,refer to the exchanges of knowledge,and actively construct a shared online communication platform for legal knowledge and thinking,so as to establish an effective communication&exchange mechanism for the application of law.
