整体性视野下长江流域环境司法一体化研究 被引量:3

Integration of environment and justice in the Yangtze River Basin:A perspective of entirety

摘要 生态系统的整体性与治理碎片化的矛盾是长江流域治理的重要瓶颈。围绕流域生态系统的整体性特征进行一体化保护是长江流域司法保护面临的新问题。文章研究发现,长江流域环境司法一体化保护已受到重视,并在实践中呈现从“传统司法”向“专门司法”、从“局部司法”向“全流域司法”、从“司法内部协作”向“司法外部协作”转变的向好趋势。但依然有一些深层次的体制机制障碍无法突破,如整合性和专业性匮乏、协同性和一体化阙如、能动性和联动性的边界不清等。立足于流域治理的整体性科学理论和“碎片化保护”客观现实,建议应从增强专门性和适应性、协同性和共享性、边界性和规范性方面采取针对性手段来予以完善。 The contradiction between ecosystem integrity and governance fragmentation is an important bottleneck in Yangtze River Basin governance.So,it is a new problem for environmental judicial protection to carry out integrated environmental protection in the situation that ecosystem in the Yangtze River basin is holistic.Research and analysis in the paper find that the integrated protection of environment and justice in the Yangtze River Basin has been paid attention in practice,and present a developmental trend from"traditional justice"to"specialized justice",from"partial justice"to"whole basin justice",from"internal judicial cooperation"to"external judicial cooperation".However,there are still some deep-rooted institutional barriers that cannot be overcome,such as lack of integration and expertise,absence of coordination and integration,and unclear boundary between initiative and linkage.In view of the above problems,based on the overall scientific theory of watershed governance and the objective reality of"fragmented protection",it is suggested that we should take targeted measures to enhance the specialization and adaptability,synergy and sharing,boundary and standardization.
