摘要
行政合同是现代行政法中合意、协商等行政民主精神的具体体现,在行政实践中作为一种替代高权行政的富有弹性的行政管理手段,大放异彩。而我国的行政诉讼模式不适应行政合同纠纷的解决,因此,确立行政合同诉讼的特殊规则是当务之急。
The administrative contract reflects the administrative democratic spirit such as agreement and negotiation in modern administrative law.Yet the administrative lawsuit pattern in our country does not suit the solution of the administrative contract disputes.Thus,it is urgent to establish the special rules of the administrative contract lawsuit.
