摘要
盘查具有行政与司法的双重属性,应在刑事诉讼法中明确其地位。从各国经验看,强化盘查的法律控制、合理界定警察的自由裁量权是平衡警察执法有效性与保障公民宪法权利的基本方法。我国盘查措施在适用中存在诸多问题,借鉴法治国家经验,强化盘查的法律控制是解决问题的基本路径。
The inventory has administrative and judicial attributes.It should be clearly written in the Code of Criminal Procedure.From other countries experiences,to strengthen legal control of inventory and to define discretion of police reasonably are two basic methods to balance effectiveness of police power and protection of constitutional rights of citizens.There are many issues in the application of inventory in China.To strengthen legal control for inventory is the basic path to solve the problems.
