摘要
“性恶论”是权力制衡学说的理论动机,“权力在运作中倾向变异”是权力制衡学说的实践动机。在国家提出“加强对权力的制约和监督”作为我国政治体制改革重要内容的背景下,我们需要充分吸取西方宪政制度的合理内核,着力建构“法治与权力制衡”的机制。
'Hypothesis of evil human-nature' is the theoretical motive,'powers' variation trend during its operation' is the practical motive.Under the circumstances of 'strengthening limitation and supervision to the powers' as one important content of our political reform proposed by CCP,we should fully absorb the reasonable essence from western constitutional system for the sake of establishing the system of 'rule-by-law and powers' check and balance'.
