摘要
社区服务刑可以避免传统监禁刑和罚金刑的一些弊端,可以达到犯罪人和社区的双赢效果,体现了轻缓化、非刑罚化的刑罚改革趋势,也是适用我国刑事司法和社区矫正工作的现实要求。社区服务刑应当定位在主刑的位置,对应判三年以下有期徒刑或者拘役的犯罪人可以考虑适用。社区服务的劳动场所应具有非赢利性,所提供的劳动项目应具有公益性,拒不完成社区服务的应易科监禁。
The community service sanction can avoid the disadvantages of imprisonment and fine,can achieve a double-win to the offender and the community,can meet the criminal trend of the mitigation and non-penaltization.So it's necessary to propose a legislation plan.The community service sanction should be located in the principal penalty.The imprisonment below three years may be taken by community service.the work place of community service should be nonprofit and the work project should be welfare.Anyone who refuses the community service will get the imprisonment.
