摘要
水资源是人类生存之本,有效的水权理论以及水权交易体制是保障水资源高效利用的重要条件。目前,我国法律对水权概念界定模糊,水权交易体制存在较大弊病,因此,有必要明确水权的内涵及其法律特征,对现行水权交易体制进行改革。
Water resource is vital to human survival. An effective water right theory and trade system on water right can safeguard the full use of water resource. However, the word 'water right' is defined dim and there is some defect in water right trade. Therefore, it is necessary to define the concept of water right and its legal character. Then, we must reform present trade system of water right.
