摘要
中国律师制度源于何时,学界存在颇多争议。中国律师制度是舶来品,这使得中国律师制度的产生方式成为研究中国律师制度历史渊源无法回避的一个重要问题。从法律移植的角度分析中国律师制度的产生,可以发现:在清末以前,中国本土资源中没有律师制度,也不可能产生律师制度。中国律师制度以一种特殊的方式———“移植”而产生。移植的过程并不顺利,在移植之初,由于国内政权的频繁更迭,国外的律师制度并没有很快在中国的本土上“成活”,而是跨越了两个历史时期,经历了长达六年的本土化过程。
The lawyers system in China is from outside. The draft act on the criminal and civil lawsuit in the Qing Dynasty, made in March, 1906, is the beginning of Chinese lawyer system. The temporary regulations on the lawyers system, made on the 16th, September, 1912,is the symble of the finishing transplant of the lawyers system, with which China lawyers system was set up.
