摘要
环境行政听证程序是指环境行政主体对环境资源实施管理、作出影响相对人重大权益的环境行政行为前 ,听取利害关系人意见的程序。环境行政听证程序具有正义、效率和参与的内在价值和保护环境行政相对人的合法权益、规范和控制环境行政权的外在价值 ;具有协调利益冲突、实现利益均衡、平衡代际关系、实现可持续发展的特有价值。
Environmental administrative hearing procedure is the procedure that the environmental administrative main body hears the idea of the person sharing the interests,before it manages the environmental source and performs environmental administrative acts to affect the important rights and interests of relative persons. Environmental administrative hearing procedure has the inside value of justice,efficiency and attending. And has the outside value of protecting the environmental administrative relative persons' legal rights,normalizing and controlling environmental administrative power;has the special value of assorting with behalf confliction and realizing behalf balance,balancing the relation between generations,realizing the continuous development.
