摘要
实证分析显示 :我国刑法所规定的 6 7个死刑罪名具有相当的公正性 ,但是 ,刑事立法更应从规范的层面对民意进行理性和科学的引导。而不只是将死刑更多地定位于保护公法益 。
The criminal law of China stipulates 67 death penalty imputations. By demonstration analysis legislation of death penalty is just. But in more extent the legislator use death penalty to protect public legal profit. Legislation of death penalty is affected by public opinion deeply. Criminal legislation should guide popular will rationally and scientifically from normative point.
