摘要
承运人的识别一直是海上货物运输相关方所面临的一项难题,该困难主要来自两个方面:一是国际公约及各国国内法对承运人概念的定义不一;二是运输方式的多样及复杂性。拟通过分析有关条文,并结合实际案例,较系统地阐述我国《海商法》下有关承运人制度。
Identification of carrier is always a difficulty to parties involved in carriage of goods by sea. The difficulty mainly arises from two circumstance: First, the different definitions of carrier in international conventions and domestic law. Secondly, diversity and complicacy in shipping operation. This article comments mainly on the system of carrier and actual carrier in CMC and discuss in this respect its advantages and disadvantages.
