摘要
破产制度的首要作用是能使全体债权人的利益得到最大限度及公平的保障。要实现这一目标 ,就必须严格规范破产清算 ,正确界定破产财产 ,采取破产无效行为制度与撤消权制度相结合模式。
The first function of bankrupt regulation is to highly and fairly ensure the interests of all the creditors. In order to reach the goal, it must regulate the bankrupt clearing strictly, bound the bankrupt property rightly and adopt to combine the regulation of bankrupt void and the institution of disaffirm regulation together.
