摘要
社会抚养费的征收行为在我国一直存有广泛的争议,争议主要集中在征收的性质、征收依据的合宪性等问题上,这些问题直接关系社会抚养费征收的定位和正当性,而湖北省发生的最高额社会抚养费征收事件正是其典型事例。社会抚养费的征收应当属于宪法上义务性征收的范畴,该案中高额社会抚养费征收的依据是《湖北省人口与计划生育条例》,从法律保留原则和平等保护原则的视角来看,该条例在形式上和实质上都具有合宪性。
