摘要
长期以来,刑事案件中刑民交叉问题一直是困扰着实务工作者的一个难题,处理不好会导致公民对司法的信任丧失,贬损了司法的权威。因此,认真思考刑民交叉问题,研究其原因和对策,对于刑法功能的恢复,司法权威的增强,意义重大。
For a long time,criminal and civil punishment in criminal cases is a difficulty puzzling the people in practice.Inappropriate disposal will result in people s loss of trust in judicature and derogate its authority.Therefore,carefully thinking of the issue and study its casues and countermeasures will be of great significance for recovering the functions of criminal law and strengthening the judicial authority.
