摘要
《鹿特丹规则》设定了海运履约方制度,并制定了一套与海运履约方相关的实质性赔偿机制,这一独具特色的制度使得调整多式联运的法律在海上货物运输中得以突破。我国《海商法》中的实际承运人相当于海运履约方,但实际承运人这一充满争议的制度一定程度上阻碍了我国海上货物运输的发展,在未来修改我国《海商法》之时有必要引进海运履约方来完善实际承运人制度。
The Rotterdam Rules has set up the maritime performing party system,also established the essential liability regime for the maritime performing party,the characteristic legal system makes a breakthrough in the multimodal transport of the carriage of goods by sea.The actual carrier in the Maritime Code of the People's Republic of China is equivalent to the maritime performing party,however,a lot of disputes arise regarding the actual carrier system,to some extent,it has hindered the development of the shipping practice in China,in the future,it is indispensable to introduce the maritime performing party to perfect the actual carrier system in the process of the amendments to the Maritime Code of the People's Republic of China.
