摘要
实施十多年的《国家赔偿法》已经不能适应社会现实的需要。其中,由于没有关于精神损害赔偿的规定,许多案件的受害人仅仅能依据《国家赔偿法》获得直接物质损失的赔偿,精神损害却得不到丝毫的抚慰,这使得《国家赔偿法》的处境甚为尴尬。2008年《国家赔偿法》的修改已经列入全国人大的立法修改议程,其中关于增加精神损害国家赔偿的内容已成为学界的共识,并在《国家赔偿法修正案(草案)》中有所体现。
'National Law of Compensation',which is implemented more than ten years,already could not meet the social reality need.And,as a result of without the stipulation of spirit damage compensation,many case's victims rest on 'National Law of Compensation',merely obtains the direct material loss,the energetic harm actually cannot obtain comforting slightly,this causes the situation of 'National Law of Compensation' is really awkward.The revision of 'National Law of restitution(2008)' has been already included in National People's Congress's legislative revision agenda,meanwhile,adding the content of mental injury has become a consensus in the educational world,and has manifested in 'The National Law of Restitution Bill for Amendment(Draft)'.
