摘要
劳动合同虽是私法契约,但常以法律对用人单位的契约自由加以限制。民用航空领域,飞行员在劳资关系中具有一定主动权,其利用契约机会主义主动单方解约较为频繁。为此制定之"五部委规章"彻底剥夺劳动者契约自由,并导致飞行员之行为危及公共利益,同时亦造成法院的法律适用困境。建议《劳动合同法》从明确违约金的特殊适用规则及企业特定人力资源的单方解约权两个层面予以改进,减少契约机会主义影响。
Although the labor contract is private contract, the law often restrains contractual freedom of the employer. In civil aviation area, pilots in the active status and utilize their right to rescind the contract very often.The regulation drafted by the government deprives the contract freedom of employee, and caused the pilots have endangered public interests. Meanwhile, the regulation caused the dilemma of the court's applying law. The Labor Contract Law of the People's Republic of China should revise the rule of the penalty for breach of contract and refin the unilateral right of pilot's right to rescind the labor contract.
