摘要
新民事诉讼法施行以来,基层民事检察工作陷入了工作数量缩减、工作重心转移、监督力度减弱、工作难度加大、制度空白较多的困境。多重因素导致了目前基层民事检察工作的困境。梳理法律空白、出台办案规则,完善相关制度、减少案外制约,尊重司法规律、转变监督理念是突围基层民事检察工作面临困境的应对之策。
Since the implementation of the new Civil Procedure Law of the People's Republic of China,the basic level civil prosecution,which is in a transition and adjustment period,have the difficulties in reducing of the number of jobs,the shift of the work focus and weakening oversee efforts and more gaps in the system. Many reasons caused the difficulties. Combing legal gaps,the introduction of handling rules,the improvement of relevant systems,the reduction of constrainting on outside cases,the respect for judicial laws,and changing oversight philosophy are the countermeasures to break through difficulties that basic level civil prosecution is facing.
