摘要
村治建设是当前城镇化进程中亟需关注的问题,村民自治的路径选择关乎我国村治的成效,关乎广大农民当家作主和各项民主权利的实现。为了能更好地探索我国的村民自治的路,我们想以当年梁漱溟及其村治理论虽饱受争议和病诟,但至今仍不失其理论创新的光辉。梁漱溟提出的村治"七难题"为线索,从宪法学视角对民国初期所兴起的乡村自治运动进行分析,以求探索当前新型城镇化建设背景下村治建设之路。
Village administration is a subject that needs great concern in current urbanization. The choice of means of villagers' self-government relates to not only the performance of village administration but also the fulfillment of farmers' rights. In order to explore the way of villagers' self-government in China, the author supports Liang Shuming's theory of village administration which glows with creativity to this day regardless of controversy and harsh criticism. Liang's seven difficulties in village administration inspires the author to analyze the movements of village self-government rising in the early period of the Republic of China from the constitutional perspective in pursuit of the way of village administration against the background of the current new-style urbanization.
