摘要
利益平衡是现代版权立法的基本精种。从我国《版权法》第1条的规定来分析,利益平衡是由作品创作、作品传播和作品使用三个层面构成,这一立法例对于网络环境下的利益平衡理论构建具有重要的意义。
Balance of interest is the basic spirit in modern copyright legislation. How to construct the concept of
balance of interest in cyberspace is a key task that the legal professionals are confronted with. Through careful
analyses of the first article of the Chinese Copyright Law, we find balance of interest consists of three levels,
namely, creation, dissemination and utilization. The Chinese enlightening legislation plays a model role in con-
structing balance of interest in cyberspace.
