摘要
清代的司法制度沿续前朝而略有变通。本文所述上及机构、职掌、审理、量刑;下至监狱、刑场、囚禁、执刑,可以窥见集权制度下法律的不平等与刑罚的严酷。清代の司法制度はその前の明朝の制度に一部更を加ぇたものでぁゐ。上は机构、职务、审理、刑量から下は监狱、刑场、禁固、刑の执行に至ゐそれを见れぼ、集权制度下の法律がぃかに不平等でめり,刑罚がぃかに严しかつ促音“フ”たかがわかゐ。
The setup of the three judicial depart- nents——the Board of Punishments. the Grand Court of Revision and the Court of Censors—— of the Qing Dynasty followed the system of the Ming Dynasty in the main. From their functions and duties, trial of cases, measurements of enalty, and even jail, imprisonment, execution ground, etc., we can get a hint of the unequality of law and the cruelty of punishment under the centralized system.
